Sistema prisional brasileiro: máquina impulsionadora de despersonificação humana

Abstract

The prison reality in Brazil is a social issue that deserves to have the eyes turned to him within a perspective that discusses on the psychological damages that affects the prisoners that experience a jail of denial of rights and annulation of the subject. Prison, as a stage of depersonification and mortification of the "I", compromises the legal security of the law and its normative basis, rendering illegitimate the coercive power of the State. The present article analyzes primarily the psychological implications of an inhuman treatment offered to prisoners in the construction of a criminal identity. It understands and studies the phenomenon of human dismantling in the face of a prison reality of violation of rights and constitutional guarantees, detaching itself from any vanity of law and seeking information in other human sciences such as history, psychology / psychoanalysis and criminology. He drinks from the science of criminology in order to problematize dehumanization in prisons and to delineate the proliferation of delinquency, explaining how resocialization measures become ineffective in Brazil. To do so, it uses the qualitative method through bibliographical references and analysis of texts, taking a historical perspective on the evolution of sentences and the rancor of private revenge still present in the desire to punish our society, and finally brings a psychoanalytic analysis to better understand the misrepresentations of the personality before the jail and the consequences of the loss of the identity. It has the conclusion that it is necessary to warn and warn society and the State about the disproportionality of the penalty and the harmful effects that pass through the person of the victim and go beyond the walls of the prison.
